AKUNGBA OBASHIP TUSSLE:SUPREME COURT ENDS PROTRACTED ROYAL LEGAL BATTLE, AFFIRMS PRINCE OSENI ISIAKA ADU AS AUTHENTIC ALALE

The Supreme Court has dismissed an appeal filed by Prince Julius Agboola Olanipon challenging the appeal court judgment that affirmed the selection process of prince Oseni Isiaka Adu from Agure/Mokun Of Ole Ruling House by kingmakers as Alale Elect Of Akungba Akoko in Akoko South West area of Ondo State.

The appeal was Filed by the appellant on the 28th /12/2017.

The Apex Court which delivered its judgement on the 13th of October 2021 in the suit number SC155/2018 involved the appellant Prince Julius Agboola Olanipon and Oseni Adu and 7 others.
In a unanimous judgment on the Protracted legal battle over Obaship tussle in Akungba Akoko that lasted for almost two decades the five man panel of justices of apex court headed by justice Mary Ukaego Peter-Odili(JSC)now retired dismissed the appeal for incompetence and therefore upheld the appeal court judgment that affirmed the candidature as well as coronation of Prince Oseni Isiaka Adu as the authentic Alale Of Akungba Akoko in Akoko South West areas of Ondo State.
Other members of the panel includes Justice Kudirat kekere Edun, Justice Ejembi Eko, Justice Mohammad Lawal Garba and Justice Ibrahim Musa Mohammad Saulawa.
It would be recalled that Alale stool became vacant after late Oba Adekanye Omosowon joined his ancestors in December, 2003.

The Obaship tussle had attracted litigation from Ajimoh lineage of Ole ruling family, challenging the selection of Prince Oseni Isiaka Adu from Agure-Mokun lineage by the town’s kingmakers.

However,Justice B.F Adeyeye of the High Court of Ondo State
sitting in Ikare-Akoko had on December 20,2013 upheld the kingmakers’ selection of Prince Oseni Isiaka Adu as the Alale-Elect from Agure Mokun branch of the Ole Ruling House and members of his lineage had right to the Alale stool.

Not satisfied with the judgment, Ajimoh branch of Ole Ruling House approached the Court of Appeal to upturn the verdict claiming that Agure Mokun family was not entitled to the stool, which the court of appeal declined their request
and subsequently affirmed trial court judgement in favour of preince Oseni Isiaka Adu as authentic monarch from Agure/Mokun Branch Of Ole Ruling House

While awaiting the verdict of the appellate court, at the twilight of the ex governor Olusegun Mimiko’s administration,one Sunday Ajimoh was installed as the Alale of Akungba Akoko.
Meanwhile, counsel to Alale Elect, Gani Ashiru in a letter sent to Ondo state government urged Governor Oluwarotimi Akeredolu SAN to immediately commence as a matter of urgency approve the selection and installation of his client as the new monarch of Akungba-Akoko since all courts’ verdicts up to the Supreme Court had been in his favour.

Alale Elect Prince Oseni Isiaka Adu who appreciated God Almighty for the unshakeable victory and people of Akungba Akoko for their resilience throughout the legal battle therefore urged Governor Oluwarotimi Akeredolu, SAN to provide Water tight security in Akungba Akoko to forestall any breakdown of law and order following the verdict of the Apex Court.
